WAUSEON CITY COUNCIL MEETING
Monday, April 3, 2006 at 5:00 P.M.

This meeting of the Wauseon City Council was called to order at 5:00 p.m. by Mayor Dehnbostel.
Following the Pledge of Allegiance and moment of silence, roll was called by the Clerk of Council.
Present were Council President Stiriz, Councilors Garvin, Krumm, Huner, Shaw and Mathews.

APPROVAL OF PRIOR MEETINGS’ MINUTES

Councilor Krumm made a motion and seconded by Councilor Garvin to approve the previous
meetings’ minutes.
VOTE: 6 Yeas - 0 Nays MOTION CARRIES

COMMITTEE REPORTS

Safety and Code

Councilor Krumm reported on the Safety and Code Committee. Regina Moore, Cost Recovery
Corporation, made a presentation to the committee about billing insurance companies for vehicle
crash reports. Ms. Moore explained the service her company provides. The handouts were
copied for all of council in their packets. There are different ways that this can be billed out –
for example the type of crash and length of time an officer(s) takes to fill out the report. The
committee will need to determine if this program were adopted whether fees for crash reports
will only be charged for non-residents involved in accidents and not for in-town residents.
The committee was not ready to act on this matter. They will meet again and discuss.

DEPARTMENT HEAD REPORTS

Steve Brown, Regional Planning Director

Mr. Brown said that the State or Ohio has approved the loan application for Wauseon Machine.
Mr. Brown explained new legislation that is being proposed by the State called Transfer
Development Rights Administration. He said that other states such as Pennyslvania and New
Jersey have been big on this. This legislation may not happen until next year.

Marv Wheeler, Fire Chief

Chief Wheeler said the Fire Department will have their Fire Safety Trailer at the Home and
Trade Show. Chief Wheeler gave an update on the new aerial truck.

Keith Torbet, Police Chief

Chief Torbet said that there is a motion before Council regarding the VAWA and JAG grants.
He explained the grants will be used for the purchase of radio equipment, software, and funding
for safety city, etc.

Tom Hall, Code Administrator

Mr. Hall said that the state is requiring that each city pass legislation that certifies the building
department. He said that this needs to be done by the end of the year but recommended
that this could be done now rather than wait until the end of the year.

Jon Schamp, Director of Finance

Mr. Schamp said he has provided council with the financial reports for the month of March, 2006.

Carrie Nixon, Director of Law

Ms. Nixon said that she has been working on several matters as seen by the legislation presented
for this meeting. She also has been working with Toledo Edison regarding easements.

FIRST READING OF LEGISLATION OR EMERGENCY

Mayor Dehnbostel read out loud by title the following legislation presented for first
reading or emergency:

Wauseon Machine and Manufacturing, Inc. – Revolving Loan Fund

Resolution 2006-4 – Accepting the Recommendations of the Revolving Loan Fund Committee;
Authorizing the Mayor to Enter into an Agreement with Wauseon Machine and Manufacturing
Inc. and Its Principals

Councilor Krumm made a motion and seconded by Councilor Mathews to take Resolution 2006-4
from the table.
Vote: 6 Yeas 0 Nays

Councilor Huner made a motion and seconded by Councilor Garvin to place Resolution 2006-4 on
first reading and the first reading be passed.

Amended Resolution of Necessary – Glenwood Avenue, Wagner Street and Banister Street

Resolution 2006-5 - Amending Resolution No. 2005-10 Adopted April 22, 2005, Declaring it
Necessary to Improve in the City of Wauseon Glenwood Avenue, Wagner Street, and Banister
Street, Between Certain Termini, by Excavating, Grading, Draining, Paving and Constructing
Curbs, Storm Sewers and Sanitary Sewers, Installing and Replacing Water Mains, and Seeding
and Mulching, Together with all Necessary and Related Appurtenances thereto, and Declaring
an Emergency

Councilor Krumm made a motion and seconded by Council President Stiriz to suspend the rules
requiring three readings on Resolution 2006-5 and declaring an emergency.
Vote: 6 Yeas – 0 Nays Motion Carries

Council President Stiriz made a motion and seconded by Councilor Huner to place Resolution
2006-5 on final passage whereas an emergency was declared.
Vote: 6 Yeas – 0 Nays Resolution 2006-5 Passes and is in Effect

Add Fifth Third Bank as a Public Depository

Resolution 2006-6 – Designating Fifth Third Bank as a Public Depository and Awarding
Public Monies and Authorizing the Mayor to Sign Memorandum of Agreements with Fifth
Third Bank and the City of Wauseon

Councilor Huner made a motion and seconded by Councilor Mathews to suspend the rules
requiring three readings on Resolution 2006-6.
Vote: 6 Yeas – 0 Nays Motion Carries

Councilor Krumm made a motion and seconded by Councilor Mathews to place Resolution
2006-6 on final passage.
Vote: 6 Yeas – 0 Nays Resolution 2006-6 Passes and is in Effect in 30 Days –
May 3, 2006

Annexation – Fulton County Health Center Expansion (12.222 acres)

Ordinance 2006-5 – Accepting Certain Territory for Annexation into the City of
Wauseon (Fulton County Health Center – 12.222 acres)

Councilor Garvin made a motion and seconded by Council President Stiriz to place
Ordinance 2006-5 on first reading and that the first reading be passed.
Vote: 6 Yeas – 0 Nays First Reading Passes

Fire Department Members (Minimum of 30 to a Maximum of 50)

Ordinance 2006-6 – Amending Section 139.01 of the Codified Ordinances of the
City of Wauseon

Councilor Krumm made a motion and seconded by Councilor Mathews to place Ordinance 2006-6
on first reading and the first reading be passed.
Vote: 6 Yeas – 0 Nays First Reading Passes

Increase Parking and Handicap Parking Ticket Violations

Ordinance 2006-7 – Amending Section 351.99 of the Codified Ordinances of the City of
Wauseon (Parking Violations)

Councilor Mathews made a motion and seconded by Councilor Huner to place Ordinance
2006-7 on first reading and that the first reading be passed.
Vote: 6 Yeas – 0 Nays First Reading Passes

SECOND READING OF LEGISLATION

There was no legislation presented for second reading.

THIRD READING OF LEGISLATION

Mayor Dehnbostel read out loud by title the following legislation presented for third reading:

Sirens for Police Bicycles

Ordinance 2006-4 – Amending Section 373.05 of the Codified Ordinances of the City of
Wauseon (Allow sirens for police bicycles)

Councilor Huner made a motion and seconded by Councilor Krumm to place Ordinance
2006-4 on third reading and that the third reading be passed.
Vote: 6 Yeas – 0 Nays Ordinance 2006-4 Passes and is in Effect in 30 Days –
May 3, 2006

NEW BUSINESS

Monthly Reports

The month-to-date bank report, month-to-date fund report, month-to-date revenue
report for March, 2006 and YTD Gross Income Tax Receipts report was distributed to Council.

VAWA and JAG Grants

Councilor Shaw made a motion and seconded by Councilor Krumm to authorize the Mayor
or his designee to make application for the Justice Assistance Grant (JAG) and the
Violence Against Women Act (VAWA) grant and to execute any and all documents
necessary to participate in the grant programs.
Vote: 6 Yeas – 0 Nays Motion Carries

Tree Commission – Ivan Hite

Mayor Dehnbostel read out loud a letter from Ivan Hite that said he will be resigning
from the Planning Commission and Tree Commission as soon as a replacement is found.
His responsibilities as a Clinton Township Trustee are not offering him the time necessary
to devote to these other commissions.

Mayor Dehnbostel said that he would like to appoint Councilor Mathews to fill the unexpired
term of Ivan Hite on the Tree Commission. He would like a motion to accept the resignation
of Ivan Hite on the Tree Commission and appoint Don Mathews for the unexpired term to
December 31, 2007.

Councilor Garvin made a motion and seconded by Councilor Huner to accept the resignation of
Ivan Hite on the Tree Commission and appoint Don Mathews for the unexpired term to
December 31, 2007.
Vote: 6 Yeas – 0 Nays Motion Carries

APPROVAL OF BILLS

Motion made by Councilor Huner and seconded by Council President Stiriz to approve and
pay the bills as presented

ADJOURNMENT

There being no further business to come before this session of the Wauseon City Council,
Mayor Dehnbostel asked for a motion to adjourn. Councilor Krumm made a motion and
seconded by Councilor Mathews to adjourn this meeting at 5:25 p.m.
